TERMS OF SALE & DELIVERY

These Terms of Sale ("Terms") apply to beer and merchandise you order for delivery from Newburgh Brewing Company, LLC ("Newburgh Brewing," "we," "us," or "our") through our online store at newburghbrewing.com/shop. By placing an order, you agree to these Terms. Please also review our Privacy Policy & SMS Terms.

AGE VERIFICATION (21+)

You must be at least 21 years of age to order alcoholic beverages. By placing an order, you certify that you and the person receiving the delivery are 21 or older.

A valid, government-issued photo ID showing the recipient is 21+ is required at the time of delivery. The person accepting the delivery must be 21 or older, present ID, and be sober. If no one 21+ is available, if ID cannot be provided, or if the recipient appears intoxicated, we will not complete the delivery, and a restocking/redelivery fee may apply. This is required by New York State law.

ORDERING & AVAILABILITY

• We deliver once a week, on Thursdays, within approximately 25 miles of the brewery. Orders just outside that area may be accommodated for larger orders at our discretion.
• Orders must be placed by our weekly cutoff (end of day Wednesday) to be included in that Thursday's delivery. Orders placed after the cutoff are scheduled for the following Thursday; we will confirm your delivery date by email.
• Products are subject to availability. Selection varies week to week. If an item becomes unavailable after you order, we will contact you to substitute, adjust, or refund that item.
• Placing an order is an offer to purchase. We may accept or decline any order, and we may limit quantities, at our discretion.

PRICING & PAYMENT

• Prices are shown in U.S. dollars and are subject to applicable sales tax. Prices may change at any time, but the price shown at checkout is what applies to your order.
• Payment is processed securely by our payment provider (Square). We do not store your full card number. By providing payment information, you authorize us to charge the total shown at checkout, including any tip you select.
• Promo codes are subject to their own terms (eligibility, expiration, and limits) and cannot be combined unless stated.
• For orders that need manual review (for example, addresses near the edge of our delivery area), your card is charged only after we confirm the order.

DELIVERY

• We deliver to the address you provide. Please make sure it is accurate and that someone 21+ will be available to accept and show ID.
• If we cannot complete a delivery because no eligible adult is available, the address is inaccessible, or ID requirements are not met, we will attempt to contact you. Re-delivery may require an additional fee, and undeliverable alcohol cannot be left unattended.
• Delivery windows are estimates and may be affected by weather, volume, or other factors outside our control.

RECURRING (SUBSCRIPTION) ORDERS

If you set up a recurring delivery, you authorize us to charge your card on file for each scheduled order at the then-current prices. We send a reminder before each charge so you can skip, change, or cancel. You can pause or cancel a recurring order at any time from your account before the weekly cutoff. The same age-verification and delivery requirements apply to every recurring order.

CANCELLATIONS & REFUNDS

• Before the Wednesday cutoff: you can cancel or change an order for that week's delivery by contacting us at deliver@newburghbrewing.com. We will refund canceled orders in full.
• After the cutoff: we may have already prepared your order, so cancellations may not be possible. Contact us as soon as possible and we will do our best to help.
• Problem with your order: if an item arrives damaged, is incorrect, or is missing, contact us within 48 hours of delivery and we will make it right with a replacement or refund.
• Because we sell perishable food and beverages and regulated alcohol, we generally cannot accept returns of delivered products. Refunds are issued to the original payment method.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages. Nothing in these Terms limits any rights you have that cannot be limited under applicable law.

CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. The Terms in effect when you place an order apply to that order.
